Web Copyright Information The Ear It service is owned and operated by The Name Engine, a privately-held website. All content displayed within the Ear It content box is the property of The Name Engine and/or its affiliates. No portion of the materials on these pages may be reprinted or republished in any form without the express written permission of The Name Engine. 2. Trademark Notice The Name Engine logo, the Ear It icon, and the “Hear It” microphone logo are trademarks of The Name Engine. All other trademarks, service marks and logos displayed with this service are the trademarks, service marks or logos of their respective owners. 3. However, it makes no guarantees as to the correctness or accuracy of the service. It is possible that the Ear It application could include inaccuracies or errors, and that unauthorized additions, deletions and alterations could be made to the service by third parties. In the event that an inaccuracy arises, please email The Name Engine at info@thenameengine.com so that it can be corrected. 4. Advertising The Ear It application is made available to web publishers free of charge. In order that The Name Engine may continue to offer this service at no cost to you, advertisements and/or sponsorships may appear within the Ear It content box from time to time. Third-party companies employed to serve these ads may use non-personal information about your visitors’ usage of the service and visits to other websites in order to provide advertisements that are of interest to them. 5. Termination The Name Engine reserves the right to terminate your use of the Ear It service at any time, with or without cause. Privacy The Name Engine respects your privacy and will never sell or voluntarily provide your information to third-party interests. Miscellaneous This Agreement is entered into in the State of Missouri and shall be governed by and construed in accordance with the laws of the State of Missouri, exclusive of its choice of law rules. Each party to this Agreement submits to the exclusive jurisdiction of the state and federal courts sitting in the County of Greene in the State of Missouri, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any action to enforce this Agreement, the prevailing party will be entitled to costs and attorneys' fees. In the event that any of the provisions of this Agreement are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect. This Agreement constitutes the entire agreement between the parties hereto pertaining to the subject matter hereof, and any and all written or oral agreements heretofore existing between the parties hereto are expressly canceled. The Name Engine may modify the terms of this Agreement by posting notice of such modification on the Ear It administrative page, located at www.thenameengine.com/earit, entitled "Legal Notices" or "Legal Information" (or similar title) before the modification takes effect. Your use of the Ear It service after the posting of any changes to this Agreement constitutes your acceptance of those modifications.
